Legal Hearings, etc.
  • Jury trial of Curtis Williams, aka Hex, is continuing in Dept 15 of San Diego Superior Court. Jury selection will commence Tuesday, February 27, and opening arguments are likely to occur in early afternoon (1:30p), but jury selection process has no set time. The public is normally allowed to witness jury selection but they way they run it here, they consume all seats in the courtroom to avoid public scrutiny, so you can't get in unless you fill in a seat where a juror was sitting, and that is just confusing to them so they don't like it (Although I went into Dept. 50 last Thursday during the end of jury selection and they let me in.
    • Hex was arrested during the Port Shutdown protest for crossing the street and faces a misdemeanor charge of Penal Code 148, resisting arrest or delaying/obstructing a peace officer. Hex wants the support of his fellow occupiers and media attention on his trial. This is sure to be an exciting show; Hex's attorney will be exposing police lies and presenting evidence of innocence, including exonerating video of the arrest and eyewitness testimony of fellow occupiers. Please, if even for only an hour this week, come occupy the court in support of a committed member of this movement, and stand against the continuous civil rights violations of San Diego law enforcement and the City Attorney's persecution of an innocent man.
    • Check the Facebook event for updates and to RSVP. The downtown criminal courthouse is located at 220 W. Broadway.
  • Benjamin Gasper's trial has been postponed to allow the defense to respond to new evidence brought forth by the prosecution. The newest court date is March 19th at 9:30 in department 50.
  • Mayor to get new contract-making power: See the article, a small paragraph near the bottom. City council voting this week to give Sanders more contract making power. What about the next mayor? Anybody want a new stadium (or a new stadium sign)? Article
    • Makes you wonder if this is the way the City Council holds the Mayor's feet to the fire. Don't question his authority and the fact that he violated the law, just grant more power and leave them out of it, that must be what they are thinking.
    • It also means developers get their way with little or no citizen review. We must stand against these changes!

As the bidding was about to begin on what was once the home of Valencia Williams, around 20 people stood up and started to sing: "Mr Auctioneer / And all the people here / We're asking you to call off the sale right now / We're going to survive but we don't know how."

Today defense attorney Laura Sheppard plans on making a motion for dismissal. Should the motion not be granted, defense evidence will take up most/all of today, and maybe into Thursday.   • F29 - Shut Down the Corporations -- (OSD will be participating) Occupy Portland calls for a national day of non-violent civil disobedience targeting corporations who are members of ALEC, one of the most successful mechanisms that the 1% uses to control legislation. We are asking people around the country to choose members of ALEC in their home towns and SHUT DOWN BUSINESS AS USUAL - Occupy Riverside is having an action at the largest WalMart distribution center in the country at 4155 Wineville Ave, Mira Loma, CA 91752 (thanks, Chris M).   • (11a) -- San Diego City College - Walkout, rally and march at Curran Plaza All occupiers are invited to participate; bring signs, cowbells, drums, noisemakers. A rough timeline: 11 AM - Gather and rally at Curran Plaza. 11:20 - March through campus to meet at noon back at Curran Plaza for speakers from different local groups, open mic, musical entertainment, then at 1 PM or sometime thereafter march from Curran Plaza through Civic Center Plaza, then down to gather at Childrens Park at 2 PM, for food/water/refreshments. Anyone is encouraged to bring any sort of ready-to-eat dish and/or liquid refreshments to share. Later on a march up to the "Governor's Office", the state building at 1350 Front St., where Occupy South Bay San Diego will continue with a rally from 4:30 - 6:30 to protest budget cuts to education and call for the 1% to pay for their fair share of taxes.

Just got news that Shahrokh's brother passed away from a heart attack. Shahrokh has been with Occupy SD from before the start. And even though he doesn't have Facebook he really does exist. He could use condolences and support today from those that know him. Sounds like he'll be heading up to San Jose soon though plans are up in the air. Spinach Williams, Cynthia Tecson and I just met his twin brother and mother in San Jose just a few weeks ago.

    • It usually takes about 6 hours for someone who has been arrested to pop up here. This site will tell you their charges, bail, etc. Jail's number is (619) 615-2700. The jail won't tell you much if anything that is not on the website. Please check this website before saying someone is in or out of jail to avoid confusion.
  • FYI -- Penal Code 849.5. In any case in which a person is arrested and released and no accusatory pleading is filed charging him with an offense, any record of arrest of the person shall include a record of release. Thereafter, the arrest shall not be deemed an arrest, but a detention only.
